INTRODUCTION

The City of Calgary (The City) knows that this transition may be a challenging process. To assist, The City is offering the Midfield Closure Program, as described in this Information Booklet and briefly outlined below:

A tenant, as defined in this Information Booklet, may be eligible to access the following:

  • the mobile home removal fund - up to a maximum of $10,000:
    • further details and eligibility requirements are described in Section 3.2 of this Information Booklet;
  • the tenant closure payment of $10,000:
    • further details and eligibility requirements are described in Section 3.3 of this Information Booklet; and
  • legal fee reimbursement of up to a maximum of $500:
    • further details are described in Section 3.1 of this Information Booklet.

For further details regarding moving/demolition process and the eligibility requirements for the mobile home removal fund and the tenant closure payment, please refer to Section 3 of this Information Booklet.

A resident, as defined in this Information Booklet, is eligible to access the following social service supports provided by Homewood Human Solutions (Homewood):

  • the resident assistance program, as described in Section 2.1; and
  • the alternative living accommodation program, as described in Section 2.2.
For further details regarding how to access the two programs offered by Homewood, please refer to Section 2 of this Information Booklet.

SECTION 1 IMPORTANT INFORMATION FOR THE MIDFIELD CLOSURE PROGRAM

The City of Calgary is offering the Midfield Closure Program as described in this Information Booklet. The following words and phrases when capitalized in this Information Booklet shall have the following meanings:

  • Agreement: means any tenancy agreement, lease or license in good standing, with The City of Calgary, Calhome Properties Ltd., or Calgary Housing Company for a mobile home site in Midfield and includes any assignment of same.

  • Clean and Clear: means that the mobile home, all improvements and all excess materials will be completely removed from the mobile home site. Improvements and excess materials include, for example:
    • Shed
    • Porch
    • Fence
    • Blocking
    • Skirting
    • Any garbage or debris (e.g. hazardous materials, old equipment, carports, planters, concrete blocks, patio blocks, etc.).

  • CHC: means Calgary Housing Company.

  • Eligible Moving Expenses: means the actual costs incurred by the Tenant for the following:
    • to move or demolish the mobile home, including all attachments or other improvements;
    • for blocking and skirting at a new location;
    • for the costs of any required permits for moving or demolishing the mobile home; and
    • for disconnecting utilities and for reconnecting utilities at a new location.

  • Homewood: means Homewood Human Solutions.

  • Midfield Closure Program: The Midfield Closure Program includes the following items:
    • the Mobile Home Removal Fund;
    • the Tenant Closure Payment;
    • Legal fee reimbursement; and
    • Homewood social services support including the resident assistance program and the alternative living accommodation program; subject to the terms and eligibility requirements as further described in this Information Booklet.

  • Mobile Home Removal Fund: means the funds made available by The City, up to a maximum of $10,000 per mobile home site, for payment or reimbursement of actual Eligible Moving Expenses incurred by an eligible Tenant as further described in Section 3.2.

  • Release: means the release to be signed by the Tenant giving up all claims against The City of Calgary, Calhome Properties Ltd., and/or Calgary Housing Company.

  • Resident or Residents: means any individual or individual who currently is/are living in Midfield.

  • Subtenant: means any individual or individuals who rent a mobile home from a Tenant.

  • Tenant or Tenants: means the individual or individuals who is/are named on the Agreement, as a tenant, and has/have signed the Agreement. A tenant must have paid all rent due as required under the Agreement.

  • Tenant Closure Payment: means a one-time payment of $10,000 subject to the terms and eligibility requirements as further described in Section 3.3.

  • The City: means The City of Calgary.

SECTION 2 SOCIAL SERVICE SUPPORT PROVIDED BY HOMEWOOD

The City knows that this transition may be a challenging process. To assist, The City is offering is offering to Residents, as defined in this Information Booklet, access the following social service supports provided by Homewood:

  • the resident assistance program; and
  • the alternative living accommodation program.

The two programs will be offered to Residents at no cost and Residents are encouraged to use them. All conversations with Homewood will be kept confidential.

Starting May 27, 2014, Residents can call Homewood at 1-800-663-1142, 24 hours per day, and seven days a week, to access the social service support described in this Section.

2.1 Resident Assistance Program

This program will help Residents with the issues that Residents and their families might experience as a result of their move from Midfield. Residents have up to a maximum of 8 hours of this service, per mobile home household. The Resident Assistance Program can provide Residents with the following support:

  • Elder care and family care
    One of Homewood's care-giving specialists can walk Residents through the types of support available personalized for their situation. Homewood specialists can also research and work with Residents to develop a viable plan to resolve elderly housing situations.

  • Financial consultation
    Homewood staff can help Residents assess their financial situation, develop a budget, and create strategies to improve their financial health. If requested, Homewood can also explore debt resolution options with Residents and establish an orderly payment of debts program.

The Resident Assistance Program offered by Homewood will be provided over the phone or in person at their offices:

  • 1100, 510 - 5th Street SW (downtown)
  • 200 Pegasus Road NE (northeast)

2.2 Alternate Living Accommodation Program

This program will help make Residents aware of their housing and financial assistance options to help them develop their own housing plan. Residents have up to a maximum of 12 hours of this service, per mobile home household. Homewood can also help Residents with completing any necessary housing-related forms.

This service is provided onsite at Midfield in the Midfield General Office (North door). Please call Homewood to set up an appointment.

SECTION 3 MOVE OR DEMOLISH THE MOBILE HOME

The City knows that this transition may be a challenging process. To assist, The City is offering to Tenants, as defined in this Information Booklet, access to the following:

  • the Mobile Home Removal Fund - up to a maximum of $10,000. Further details and eligibility requirements are described in Section 3.2 below;
  • the Tenant Closure Payment of $10,000. Further details and eligibility requirements are described in Section 3.3 below; and
  • Legal fee reimbursement of up to a maximum of $500. Further details outlined in Section 3.1 below.

The closure also requires that a Tenant's mobile home must be removed from Midfield by September 30, 2017. Tenants are responsible to arrange for the removal of their mobile home and all personal belongings. This includes removing all additions or improvements made to the mobile home site (e.g. any shed, porch, fence, addition, etc.) as well as removing any personal items that may be stored in the Midfield storage areas.

Should a Tenant decide to abandon their mobile home in Midfield, they will not be eligible for the Mobile Home Removal Fund or the Tenant Closure Payment. Calgary Housing Company (CHC) will deal with any abandoned mobile homes and/or abandoned goods as required by the Mobile Home Sites Tenancies Act.

3.1 The Moving/Demolition Process

  • Hire a contractor.
    Tenants are responsible for finding their own contractor and negotiating their moving or demolition costs and details.

    Please note: The Tenant's contractor is responsible for obtaining all permits required for moving or demolishing the mobile home. It is recommended that Tenants choose a contractor that is bonded and insured. Tenants are encouraged to discuss this with their contractor.

  • Book a date and provide one month's written notice to CHC that a plan is in place to move or demolish the mobile home.
    When a Tenant is ready to move, they need to book a date with CHC and fill out the form on page 16 Tenant Moving Plan Notice. The completed form is to be put in an envelope addressed to CHC with the Tenant's return address, and placed in the drop box by the Midfield Property Manager's Office.

    CHC will review the Tenant Moving Plan Notice in order to coordinate all the moves off site, or demolitions on or off site, and to make sure it is done in a manner that does not create a danger for Midfield Residents or damage property in Midfield. If Tenants have any questions regarding a move or demolition of a mobile home, please contact CHC by phone at 403-277-7356 or by Fax at 403-277-7658.

  • Clear all personal items from the mobile home site and storage areas.
    Tenants should discuss with the contractor what is required to be removed from within the mobile home prior to moving it off site or to demolishing it on or off site. The contractor will advise Tenants on any requirements. In addition, Tenants are required to clear all personal items and debris from the mobile home site and to ensure that all personal items have been removed from the storage areas.

  • Ensure utilities are properly disconnected.
    Tenants are to call each of their specific utility service providers to arrange for the proper disconnection of all utilities to their mobile home.

  • Provide your signed Release to CHC.
    Once CHC has received the Tenant Moving Plan Notice, CHC will provide the Tenant with the form of Release to be signed. Tenants are encouraged to consult with a lawyer to obtain legal advice with respect to the terms of the Release. No changes to the form of Release will be accepted. If there is more than one Tenant named on an Agreement, then all Tenants must sign the Release. Once the Tenant or Tenants have signed the Release and completed the Affidavit of Execution, the completed Release is to be placed in an envelope addressed to CHC with the Tenant's return address and placed in the drop box by the Midfield Property Manager's Office.

    The City will reimburse Tenants a maximum of $500 for legal advice provided by a lawyer relating just to the Release. Please submit a copy of the lawyer's legal account to CHC for reimbursement.

  • Contact CHC and arrange for a site inspection.
    Once the mobile home site is Clean and Clear and all personal belongings have been removed from the storage areas, Tenants are to contact CHC to arrange for an inspection of the mobile home site.

    During the site inspection, CHC will complete a site inspection form with the Tenant to ensure the mobile home site is Clean and Clear, and that the Tenant has removed any personal belongings from the storage areas. CHC will provide the Tenant with a report of the inspection that describes the condition of the mobile home site.

3.2 Accessing the Mobile Home Removal Fund

  • The Mobile Home Removal Fund, up to a maximum of $10,000 per mobile home site, is available for the payment or reimbursement of the Eligible Moving Expenses incurred by the Tenant providing the Tenant meets the eligibility requirements described below.
    Eligible Moving Expenses are actual costs incurred by the Tenant for the following:
    • to move or demolish the mobile home, including all attachments or other improvements;
    • for blocking and skirting at a new location;
    • for the costs of any required permits for moving or demolishing the mobile home; and
    • for disconnecting utilities and for reconnecting utilities at a new location.

Eligibility

In order to be eligible to access the Mobile Home Removal Fund:

  1. you must be a Tenant. A Subtenant or anyone who is not the named Tenant on the Agreement, is not eligible to for the Mobile Home Removal Fund; and

  2. the Release must be properly completed, signed by all Tenants named on the Agreement and returned to CHC. Tenants may not make any changes to the form of Release provided by CHC.

Please Note the Following:

The funds available under the Mobile Home Removal Fund will firstly be used to pay for The City's estimated costs to demolish and remove any excess materials, improvements or debris left on the mobile home site. If the City's estimated costs to Clean and Clear the mobile home site are less than $10,000, then any remaining portion of the Mobile Home Removal Fund will be available for the payment or reimbursement of the Eligible Moving Expenses incurred by the Tenant.

Direct Payment vs. Reimbursement

On the Tenant Moving Plan Notice form, the Tenant must choose one of the following options:

  • to direct CHC to pay the contractor for the Eligible Moving Expenses up to a maximum of $10,000, less any costs incurred by The City to Clean and Clear the mobile home site. Any costs charged by the contractor in excess of this amount are the Tenant's responsibility to pay; or

  • to submit their invoices for any Eligible Moving Expenses to CHC. CHC will review the invoices and if satisfactory, will reimburse the Tenant up to a maximum of $10,000, less any costs incurred by The City to Clean and Clear the mobile home site. Any costs incurred by the Tenant in excess of this amount are the Tenant's responsibility to pay.

    3.3 Accessing the Tenant Closure Payment

    The Tenant Closure Payment is a one time payment of $10,000, subject to the terms and eligibility requirements described below.

    Eligibility:

    In order to be eligible for the Tenant Closure Payment:

    1. you must be a Tenant. A Subtenant or anyone who is not the named Tenant on the Agreement, is not eligible to for the Mobile Home Removal Fund; and

    2. the Release must be properly completed, signed by all Tenants named on the Agreement and returned to CHC. Tenants may not make any changes to the form of Release provided by CHC; and

    3. CHC must complete the inspection of the mobile home site and confirm that it is Clean and Clear.

    3.4 Payment/Reimbursement Process

    • CHC will calculate the amount of the Tenant reimbursement or the direct payment to the contractor from the Mobile Home Removal Fund.
      CHC will first determine the amount, if any, required for The City's estimated costs to demolish and remove any excess materials, improvements or debris left on the mobile home site. CHC will then review the invoices submitted for the Eligible Moving Expenses and if satisfactory, will calculate the amount available for Tenant reimbursement or the direct payment to contractors from the Mobile Home Removal Fund.

    • CHC will determine eligibility for the Tenant Closure Payment.
      Provided that the Release has been properly completed, signed by all Tenants named on the Agreement and returned to CHC and the mobile home site has been inspected and is Clean and Clear, CHC will process the Tenant Closure Payment.
    • CHC will mail the Tenant or Tenants a cheque.
      A statement will outline the amount of the Mobile Home Removal Fund and the Tenant Closure Payment the Tenant is eligible for. A cheque or cheques will be mailed to the Tenant and to the contractor, if applicable, within 20 business days.

      If there is more than one Tenant named on the Agreement, the available funds will be divided equally between the Tenants. Tenants are responsible for providing CHC with their new mailing address so that CHC can mail the cheque to the Tenant or Tenants.

    SECTION 4 FREQUENTLY ASKED QUESTIONS

    1. Will The City pay for legal fees?
      The City will reimburse Tenants up to a maximum of $500 for legal fees with respect to obtaining independent legal advice from a lawyer on the terms of the Release. Tenants must provide a copy of the lawyer's legal account to CHC for reimbursement.

    2. When will The City of Calgary issue the legal notice to Midfield Tenants to terminate the tenancy in Midfield?
      Tenants will be served with the required notice to terminate the tenancy at least one year prior to closure of Midfield. Tenants may also provide one months notice to CHC that they will be vacating Midfield at any point prior to September 30, 2017.

    3. When is the last day for Tenants to move their mobile home parks off Midfield?
      September 30, 2017.

    4. What happens to the Midfield Closure Program if I decide to sell my mobile home and assign my Agreement prior to the closure of Midfield?
      If you assign your Agreement to the purchaser of your mobile home, then the purchaser becomes the Tenant and may be eligible for the Midfield Closure Program in your place.

    5. What will happen to my damage deposit?
      CHC will mail to the Tenant the statement setting out the amount of the security deposit and a cheque for the security deposit, less any arrears of rent owing, within 10 business days of the Tenant moving out of Midfield.

    6. Is it fair to assume that the mobile homes closest to the entrance will move first?
      No. Tenants will need to book a moving date with CHC. The moving details will be determined by the Tenant's contractor and CHC.

    7. What if I cannot afford to pay my contractors upfront?
      If a Tenant cannot afford to pay up front for moving or demolishing their mobile home, the Tenant can direct that The City of Calgary directly pay the contractor up to the maximum amount available under the Mobile Home Removal Fund.

    8. Who is responsible for repairs and the upkeep to the park up until the closure of the park?
      CHC will continue to be responsible for repairs and day-to-day operations for Midfield. You can contact them at 587-390-1200.

    9. Is CHC going to raise the rent between now and the relocation?
      No, CHC will not raise the rent from now until closure of Midfield.

    10. Are Subtenants eligible for either the Mobile Home Removal Fund or the Tenant Closure Payment?
      No, Subtenants are not eligible for the Mobile Home Removal Fund or the Tenant Closure Payment.

    11. I am a Tenant who does not live onsite at Midfield; I sublet my mobile home to a Subtenant. Am I still eligible for the social services support, the Mobile Home Removal Fund and/or the Tenant Closure Payment?
      As a Tenant that does not live in Midfield you are not eligible for the social services support provided by Homewood. The social services support provided by Homewood is for Residents that currently live in Midfield. As a Tenant you may be eligible for the Mobile Home Removal Fund and the Tenant Closure Payment.

    12. I am a Tenant in Midfield and I need assistance in finding appropriate accommodation for my elderly parent (who does not live in Midfield). Can I use the social support services for that?
      No, the Homewood services are only for Residents who are moving from Midfield.

    13. Once a mobile home site is vacated will you rent it out again?
      No. Once a mobile home site has been vacated by a Tenant, it will not be leased again.

    14. I am a Tenant in Midfield and I need assistance with organizing removal/demolition of my mobile home. Can I get support for that?
      Financial support is available to eligible Tenants pursuant to Section 3.2 and 3.3 of this Information Booklet. There is no direct support for finding or managing a contractor, however if Tenants have any questions regarding the moving or demolition process, then please contact CHC by phone at 403-277-7356 or by fax at 403-277-7658.

      SECTION 5 TENANT MOVING PLAN NOTICE (Form)

      This form will provide CHC with your moving plan information. The completed form is to be put in an envelope addressed to CHC with the Tenant's return address, and placed in the drop box by the Midfield Property Manager's Office.
